Proposed Regulation

The Durham Middlefield Interlocal Agreement Advisory Board or“DMIAAB” proposes to adopt regulations directing Waste Haulers/Collectors to bring their waste to the Materials Innovation and Recycling Authority or “MIRA” solid waste facility in Hartford, Connecticut and issue permits for all waste haulers and collectors collecting waste in the towns of Durham and Middlefield.  The authority to direct solid waste is found in the 2012 Interlocal Agreement, Chapter 13, Durham Town Code of Ordinances (Section 13-11) and Section 22a-220a of the Connecticut General Statutes.

Section 1.


As of July 1, 2018 no commercial waste collector1 shall bring solid waste or recyclables to the DMIAAB transfer station on Cherry Hill Road. Solid waste shall be delivered to the MIRA solid waste facility in Hartford, Connecticut in compliance with the provisions of “TIER 1 LONG-TERM MUNICIPAL SOLID WASTE MANAGEMENT SERVICES AGREEMENT FOR THE PROVISION OF ACCEPTABLE SOLID WASTE SERVICES BETWEEN MATERIALS INNOVATION AND RECYCLING AUTHORITY AND DMIAAB” and “CONNECTICUT SOLID WASTE SYSTEM PERMITTING, DISPOSAL AND BILLING PROCEDURES Effective April 20, 2017”


Section 2.


As of July 31, 2018 no waste collector1 shall collect waste or recyclables in the Towns of Durham and Middlefield who has not registered with DMIAAB on a form provided which discloses at a minimum: (A) The name and address of the collector and the owner of such collection company; (B) the name of any other municipality in which such collector hauls such solid waste, including recyclables; (C) whether the hauling done by such collector is residential, commercial or other; (D) the types of waste hauled; and (E) the anticipated location of any disposal facilities or end users receiving recyclable solid waste. In addition, any waste hauler or collector shall report to DMIAAB (A) the types of solid waste, including recyclables, as listed in subsection (c) of section 22a-208e of the Connecticut General Statutes generated within the borders of Durham and Middlefield delineating the first destination where such solid waste, including recyclables, was delivered by the collector during the previous fiscal year, and (C) the types and actual or estimated amounts of such solid waste, including recyclables, directly delivered to an out-of-state destination or to an end user or manufacturer in the state. Such reports shall be submitted to the municipality annually, on or before July thirty-first, and shall provide the information specified in this subdivision for the prior state fiscal year. Such reports shall be on a form prescribed by the Commissioner of Energy and Environmental Protection and shall include any other additional information the commissioner deems necessary.


1 “Collector” shall mean any person who holds himself out for hire regularly to collect soild waste from residential, business, commercial or other establishments.  “Collector” does not include: (1) Any person who transports solid waste that is incidentally generated during the professional or commercial activities unrelated to the collection of solid waste, such as residential property repairs, provided such solid waste is self-generated by such person’s professional or commercial activities and such solid waste is transported to an authorized recycling facility, a permitted recycling facility, or a permitted solid waste facility, and (2) any person who transports used materials for the purpose of delivering such materials to a charitable organization that distributes reused household items or to a retail facility that sells reused household items.  

This regulation will become effective 15 days after publication in the Middletown Press.

The transfer station is for the residents of Durham and Middlefield. Located on Cherry Hill Road, at the intersection of Route 147. Site users are required to provide proof of residency and purchase a pass for $30.00 that must be affixed to windshield of vehicle brought to the facility.

Station Permit

In order to purchase an annual DMIAAB Transfer Station Permit the following is required:
1. Proof of Residency in Durham or Middlefield must be verified by a valid Drivers License
2. Automobile Registration must verify that the vehicle to which the transfer station permit is affixed is registered in Durham or Middlefield
3. All Transfer Station Permits Expire July 1st
What can I Bring?

Regular Household Garbage: all paper (newspaper, cardboard,office paper), bottle and cans including plastics #1 – #7 without additional fees.
Electronics Recycling: No Fee
Brush: up to 4″ in diameter and not longer than 8′ in length.
Leaves: must be emptied from bags in designated area.
Scrap metal: items must be drained of any oil or gasoline

What Shouldn’t I Bring?

No hazardous wastes such as lead based paint, asbestos or pesticides should be brought to the facility.
These items may be disposed of at Household Hazardous Waste Collection Days set up in the area throughout the late spring and summer.
No wood larger than 4″ in diameter may be disposed of at the facility.
No clean fill (rocks, concrete, dirt etc.) can be disposed of at the site
